SF Reaches Settlement Over Sale Of Drug Paraphernalia

SAN FRANCISCO -- City Attorney Dennis Herrera has announced a settlement with five smoke shops in the city accused of selling illegal drug paraphernalia exclusively intended for users and dealers of cocaine, crack and methamphetamine.

Herrera had filed civil lawsuits in February against the shops, four of which are located in the Ingleside District and the other two in the Mission District.

The stores are Mission Gifts and Tobacco at 4784 Mission St., Rock On at 4447 Mission St., The Platinum at 5901 Mission St., House of Cigarettes at 912 Geneva Ave., and Tobacco Plaza Center Smoke and Gift Shop at 3008 16th St.

A sixth store listed in the original complaint in February, Smokes, Etc. at 3186 16th St., has not settled but "is close in settlement talks," said city attorney's spokesman Jack Song.

No one was immediately available to comment on the settlement at any of the six stores.

Under the settlement agreed upon by the city attorney's office and the stores, a five-year injunction was put in place against each of the shop operators barring them from selling any illegal drug paraphernalia, and the stores had to pay between $5,000 and $11,000 in civil penalties.

The settlement also requires 80 percent of each of the storefront's windows and doors be kept clear so police can see inside, and subjects them to unannounced inspections and searches, according to Herrera's office.

Penalties of up to $6,000 can be sought for each violation of the agreement.

"I hope (Tuesday's) settlement sends a strong message to other neighborhood smoke shops in the city that San Francisco does not tolerate trafficking of illegal drug paraphernalia," Herrera said in a statement.

I absolutely hate Kelly's Mission Rock with a passion, but I got in free and really wanted to see Downlink, so I bit the bullet and mingled with 18 year olds all night. At times I wish I was 18 again, only because back then I was too oblivious to the logistics of sound engineering to care about shitty sound systems. There was a massive limiter on the system, so every time the MC got on the mic, which was far too frequently, the bass cut out and the sound system would drop down like 30Dbz so the speakers wouldn't blow out. That happens in a lot of clubs and MCs should know not to blast their levels up to max volume, then scream into the mic like a death metal vocalist. The speakers in the main room were only partially working as well. The speakers in the back, and on the sides were either turned off, or non-existent, because the only sound you heard was directly in front of the DJ booth. Since the room is really big and rectangular shaped, with the DJ booth on one end, it caused hundreds of kids to squeeze to the front, making it impossible to move, while the back end of the room was stark empty. I wanted to dance, but you couldn't hear the music in the back of the room, which was the only area where there was any space to go haywire. Downlink went from 1:30am-3am and I was listening to his full set and enjoying myself. It must have been destiny for me to just see him alone, then move along because we showed up the second he started playing, then I got kicked out the second he stopped. I got kicked out because I was wearing a bandana over my face. I guess I understand that in an 18+ event there may be some gang bangers, but this ain't LA, and we are at a dubstep event where bandanas are a trend at the moment. After I got ejected by a midget security guard with a Napolean complex, I began to realize why the bandana trend is fading. Its because the 18+ venues are banning them, and the younger crowds are usually the ones that follow or create trends. I usually don't cover my face when I party outside of gigs, but every time I go to an underage party, kids constantly try to take photos of me when they find out it's me. It's rude as fuck, but I guess their generation has even less manners than my stupid generation. I had at least 4 kids just walk up to me and pull my bandana off, and it's probably a good thing that I got kicked out or else I would have been in jail today for punching a hole through a child's face.
